Massachusetts is one of a minority of states with a no-fault auto insurance system. After most car crashes, your own insurer pays certain costs through Personal Injury Protection (PIP) coverage, regardless of who caused the collision.

PIP provides up to $8,000 in benefits per person, covering reasonable medical expenses, a portion of lost wages (generally 75% of lost income), and replacement services. The first $2,000 of medical expenses is paid by PIP before private health insurance becomes involved.

No-fault does not mean you can never sue the at-fault driver. Massachusetts lets you step outside the system and pursue a liability claim for pain and suffering when your case meets a statutory threshold — typically more than $2,000 in reasonable medical bills, or injuries involving fractures, permanent disfigurement, or loss of a body function.
